Today’s USSC ruling does not end the case anyway. The ruling only dissolved the the injunction preventing the firings. There will still be a trial where if the fired people win the amount of MONETARY DAMAGES will be determined. The ruling upholds the concept of irreparable harm. If money (aka legal damages) can take care of it, then nobody is entitled to injunctive relief (equitable damages).

The Supremes are a higher court, and it sounds as if they decided the matter, rather than sending it sending it back.

From their decision, Trump can fire the board members without cause. So it sounds as if she's toast.

Good post.

I have been saying for a while that the proper remedy is never reinstatement but rather monetary damages if the court determines harm.

The injunctions by lower courts were insane on their face.

A friend of mine was appointed by Trump to a board in 2019. Biden fired him before even taking office, along with many others. Nothing was said.

FDR fired a Republican appointee to some agency given an eight year term by Calvin Coolidge—and the Republican went to court and won...

The decision was a very narrow one and was based on the unique circumstances involved.

The leftist judges have been trying to seize on it to cripple President Trump’s firing authority.

This decision is more important than it appears because future Congresses will be far more reluctant to create such bodies in the first place. It is a structural body blow to the administrative state.
